This Indenture made this first [fourth and fifth] day of July A. D. one thousand eight hundred and forty five between of the County of , in the State of of the one part, and as administrator of the Estate of Joseph Smith deceased, of the and aforesaid of the other part, Witnesseth, that the said for and in consideration of the sum of four hundred and twelve 51/100 dollars to him paid by the said , as Administrator as aforesaid, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents, doth grant, bargain, sell, alien and confirm unto the said as administrator as aforesaid and to his successors, all those tracts and parcels of land situate in the county of in the State of , known and described as follows, to wit:— The N. W. fractional quarter of Section ten (10) in Township 7 North of Range 8 West of the 4th. principal Meridian, containing 10 acres. Also the S. W. fractional quarter of Section nineteen (19) in Township 6 North of Range 8 West aforesaid, containing 163/100 acres. Also theS. E. quarter of the S. E quarter of Section twenty six (26) in Township 7 North of Range 8 West aforesaid, containing 40 acres. Also the S. W. quarter of Section twenty five (25) in Township 7 North of Range 8 West aforesaid, containing 160 acres. Also the West half of the N. E. quarter of Section thirty five (35) in Township 7 North of Range 8 West aforesaid. To have and to hold the premises aforesaid, with all the privileges and appurtenances thereunto belonging, or in any wise appertaining, unto the said , as Administrator as aforesaid, and to his successors forever: Provided always, that these presents are upon this express condition, that if the said his heirs or assigns, executors or administrators, shall pay or cause to be paid to the said as administrator as aforesaid or to his successor the sum of four hundred and [p.
